SBN-787: Excluding Portions of the Naval Station San Miguel in San Narciso and San Antonio, Zambales from the Operation of Proclamation No. 938
An Act Excluding Certain Portions Of The Naval Station San Miguel In The Municipalities Of San Narciso And San Antonio Province Of Zambales From The Operation Of Proclamation No. 938, And Declaring The Excluded Portions Open To Disposition Under The Provisions Of Republic Act No. 730, As Amended, To Qualified Occupants Without Public Auction
This Bill proposes the following:
- to exclude an area from the 960 hectare land that had been declared as a Military Reservation Area for the Philippine Navy under Presidential Proclamation No. 938 ( Dec. 16, 1996)
- to distribute the land so segregated, called Sitio Aldea, to qualified residents
- to put the distribution under the operation of Republic Act No. 730 that permits the sale of public lands by the Government without public auction
The survey, mapping and titling processes will be at no-cost to qualified residents. The costs shall be appropriated from the budgets of the Department of Environment and Natural Resources and the Land Registration Authority.
The sale shall also be exempt from the capital gains tax. The Senate Tax Study and Research Office submitted a positive opinion on the capital gains tax-exemption of the qualified residents.
The Philippine Navy also rendered a positive opinion on the segregation.
The Bill emanated from letter of the Barangay Captains of West Dirita, Zan Antonio and Barangay Natividad, San Narciso addressed to Senator Recto, dated August 2011. Last Congress, Rep. Ebdane filed H.B. No. 6081 on the same subject matter – segregating Sitio Aldea from the PN land parcel.
The two barangays have submitted anew their respective Resolutions for consideration in the 16th Congress: Res. No. 11, Series of 2013 for Bgy. West Dirita, San Antonio & Res. No. 5, Series of 2013 for Bgy. Natividad, San Narciso.
This Bill shall be for consideration in tandem with a Presidential Proclamation carving out the Capones Island from the territory of the municipality of San Antonio, Zambales. The Proclamation shall create and designate areas for a Philippine Navy (PN) forward base in the Capones Island. This is in the form of an exchange since the PN advances the position that military installations must not be unduly diminished.
